Port Air Transfer – Customer Terms & Conditions

These Terms & Conditions govern the contractual relationship between Port Air Transfer and the customer for all transfer services booked via the platform. The relationship with partner drivers is governed by a separate partner agreement.

Section 1: Parties & Scope

  • 1. Company Information. Port Air Transfer is a registered trademark and digital booking platform of Budak First Class, registered in the Swiss Commercial Register. Registered address: Badenerstrasse 816, 8048 Zurich, Switzerland. UID: CHE-441.871.247.
  • 2. Platform Role. Port Air Transfer operates as a digital booking and intermediation platform connecting customers with independent, licensed transport providers (partners). Certain transfers may also be performed directly with vehicles owned by the Company.
  • 3. Scope of Agreement. These Terms apply to all bookings made via the Port Air Transfer website, applications, or customer service channels.
  • 4. Acceptance. By checking the confirmation box during booking, the customer accepts these Terms & Conditions.

Section 2: Provision of Services

  • 5. Service Delivery. Transfers are carried out by selected partner drivers, or at the Company's discretion with its own vehicles. Partner drivers are independent, licensed commercial contractors.
  • 6. Driver Qualification. All drivers providing services through the platform hold the required Swiss commercial passenger transport authorization (BPT).
  • 7. Customer Verification Right. The customer may request to see the driver's authorization and commercial vehicle documents prior to departure.

Section 3: Vehicle Categories & Allocation

  • 8. Category Guarantee. Images on the platform are illustrative only. Port Air Transfer guarantees the booked vehicle category, not a specific brand, model, or color.
  • 9. Discretionary Upgrade. Providing a higher category at no extra cost in case of unavailability is at the sole discretion of Port Air Transfer.
  • 10. Lower Category Offer. If neither the booked category nor an upgrade is available, the customer will instead be offered a lower category at a discounted rate.
  • 11. Customer Consent. Allocation of a lower category requires the customer's prior explicit consent.
  • 12. Rejection & Refund. If the customer declines the alternative offer, the booking is cancelled free of charge and the amount paid is refunded in full.

Section 4: Pricing, Payments & Refunds

  • 13. Inclusions. Prices are quoted in CHF and include Swiss VAT, fuel, the Swiss highway vignette, and the agreed complimentary wait times.
  • 14. Exclusions. Car-train/tunnel fees, foreign highway tolls, and special parking fees are excluded unless otherwise agreed.
  • 15. Payment Methods & Collection Capacity. Payments are processed online (Stripe) or, if approved, inside the vehicle. The Company may also collect payment as a payment agent on behalf of the partner who actually performs the transfer.
  • 15a. Deposit for Cash Payments. Where payment is made in cash inside the vehicle, the customer must pay a deposit of at least 50% of the total amount in advance; the remaining balance is due upon completion of the transfer.
  • 16. Foreign Currency. Payments made in Euro inside the vehicle are subject to the Company's current exchange rate on the day of payment.
  • 17. Partial Refunds. Refunds are never paid in cash inside the vehicle; they are credited only to the original payment method.
  • 18. Unjustified Payment Disputes. Charges appear on the statement as Budak First Class or Port Air Transfer. The Company reserves the right to pursue legal remedies against unjustified or unfounded chargebacks.

Section 5: Waiting Times, Flight Tracking & No-Show

  • 19. Airport Wait Time. Up to 60 minutes of complimentary wait time is included, starting from the flight's actual landing time.
  • 20. Address Wait Time. Up to 15 minutes of complimentary wait time is included, starting from the scheduled pickup time.
  • 21. Flight Tracking. Flight delays are monitored automatically, provided the correct flight number was entered.
  • 22. Paid Waiting Rate. After the free period expires, each additional 15-minute unit (or part thereof) is billed at CHF 30.00, subject to driver availability.
  • 23. Extreme Delays (2+ Hours). For delays exceeding 2 hours, pickup by the same driver cannot be guaranteed. If no vehicle is available, the booking is cancelled free of charge and refunded.
  • 24. No-Show Policy. If the customer cannot be reached after the wait time has expired, this is deemed a no-show; the driver departs, and the full fare is retained (no refund).

Section 6: Cancellations, Amendments & the Company's Right of Cancellation

  • 25. Written Notice. All cancellation or amendment requests must be submitted in writing via the platform, email, or WhatsApp.
  • 26. Cancellation More Than 24 Hours in Advance. Cancellations made more than 24 hours before the pickup time are refunded in full (100%).
  • 27. Cancellation Between 12 and 24 Hours in Advance. Cancellations made between 12 and 24 hours before the pickup time are refunded at 50%.
  • 28. Cancellation Less Than 12 Hours in Advance. Cancellations made less than 12 hours before the pickup time, or no-shows, are non-refundable.
  • 29. Company's Right of Cancellation. Port Air Transfer may unilaterally cancel the transfer agreement in the event of a safety risk, force majeure, vehicle breakdown, operational impossibility, or misleading information provided by the customer. In such cases, the amount paid is refunded in full (100%); no further claims apply.
  • 30. Exception to the Right of Withdrawal. Under Swiss law, the general right of withdrawal for distance contracts does not apply to transport services performed on a specific date and time; cancellations are governed exclusively by this Section.

Section 7: Limitation of Liability & Force Majeure

  • 31. Accident Liability. For transfers performed by partner drivers, physical and material damages arising from accidents are covered by the performing vehicle's mandatory commercial passenger liability insurance. For transfers performed directly with a Company vehicle, the Company's own commercial passenger liability insurance applies.
  • 32. Liability Cap. The Company's liability for service disruptions is limited to the fare paid by the customer, except in cases of intent or gross negligence.
  • 33. Exclusion of Consequential Damages. No claims may be made for missed flights, trains, or appointments, loss of earnings, or the cost of alternative transport, except in cases of intent or gross negligence.
  • 34. Force Majeure. The Company is not liable for disruptions caused by extreme weather conditions, avalanche risk, road or tunnel closures, natural disasters, or strikes.
  • 35. Safety-Related Termination. The driver may terminate the journey as soon as the safety of persons or the vehicle is at risk; in such cases, only the portion of the fare corresponding to the distance not travelled is refunded.

Section 8: Conduct Inside the Vehicle

  • 36. VIP Standard. Complimentary bottled water is provided inside the vehicle; any further catering requests are not included in the price.
  • 37. Seatbelt Requirement. Under Swiss road traffic law, all passengers are required to wear a seatbelt.
  • 38. Child Seats. Properly securing children in a child seat is solely the responsibility of the parents or accompanying adults.
  • 39. Smoking & Alcohol Ban. Smoking, the use of e-cigarettes, alcohol consumption, and the use of illegal substances are strictly prohibited in all vehicles.
  • 40. Refusal of Service. Passengers who endanger the driver, or who are significantly intoxicated or aggressive, will be denied transport without any entitlement to a refund.
  • 41. Cleaning Costs. In the event of excessive soiling of the vehicle by the customer, the Company will invoice the customer for the actual and documented cleaning costs incurred.
  • 42. Property Damage. Damage to the vehicle's equipment or interior caused intentionally or negligently will be invoiced to the customer in full, based on the actual costs incurred.
  • 43. Pets. Pets are only transported following prior notification and when secured in a suitable transport carrier (guide dogs excepted).

Section 9: Data Privacy, Governing Law & Jurisdiction

  • 44. Data Protection. Personal data is processed in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the GDPR, and is shared only with the relevant driver/partner for operational purposes.
  • 45. Governing Law. These Terms are governed exclusively by Swiss law.
  • 46. Place of Jurisdiction. The exclusive place of jurisdiction for any disputes is Zurich, Switzerland.
  • 47. Severability. Should any individual provision of these Terms be or become invalid, the remaining provisions shall remain unaffected.
